Terms of Service

By downloading, installing, or using the ClearAir application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

ClearAir is a vaping cessation companion app designed to help users track their progress in quitting vaping. The App provides:

• Quit date tracking and day counters
• Money saved calculations
• Health recovery timeline and milestones
• Relapse logging and pattern analysis
• Breathing exercises for craving management
• Motivational pledge cards
• Push notification reminders

ClearAir is not a medical application and does not provide medical advice, diagnosis, or treatment. The health milestones, timelines, and information presented in the App are for general informational and motivational purposes only.

The App is not a substitute for professional medical advice. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or nicotine addiction treatment.

If you are experiencing a medical emergency, call your local emergency services immediately.

You must be at least 17 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement.

5.1 Premium Subscription

ClearAir offers auto-renewing subscription plans to access premium features. Subscription options and pricing are displayed within the App.

5.2 Billing

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.

5.3 Free Trial

If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription.

5.4 Price Changes

Prices may change at any time. If the price of a subscription increases, you will be notified and required to agree to the new price before your subscription renews at the higher rate.

5.5 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple. We do not have the ability to process refunds directly. To request a refund, visit reportaproblem.apple.com.

Your use of the App is also governed by our Privacy Policy. Key points:

• All habit-tracking data is stored locally on your device
• We do not collect, transmit, or sell your personal health data
• Subscription data is processed by RevenueCat and Apple
• You can delete all your data at any time from within the App

7.1 Apple Sign In

The App offers optional Sign in with Apple. You are not required to sign in to use the App. If you choose to sign in, your Apple user ID is used to personalize your experience.

7.2 Data Portability

Your data is stored locally on your device. If you delete the App or switch devices, your progress data will be lost unless you have signed in with Apple and syncing is available. Your subscription can be restored on any device using the “Restore Purchases” feature.

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels on the App
• Use the App in any way that could damage or impair the service
• Share your subscription access with others

All content, features, and functionality of the App — including but not limited to text, graphics, logos, icons, images, and software — are the exclusive property of ClearAir and are protected by copyright, trademark, and other intellectual property laws.

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• The health information presented is complete or accurate for your specific situation
• The results obtained from using the App will be accurate or reliable
• Any defects in the App will be corrected

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLEARAIR, ITS DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, HEALTH OUTCOMES, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

You agree to indemnify and hold harmless ClearAir and its developers from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your use of the App or violation of these Terms.

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

We may revise these Terms at any time by updating this page. The “Last Updated” date at the top indicates when the Terms were last revised. Your continued use of the App after changes constitutes acceptance of the revised Terms.

Your use of the App is also subject to Apple's standard End User License Agreement (EULA), available at apple.com/legal/internet-services/itunes/dev/stdeula.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

If you are a consumer in the European Economic Area (EEA), United Kingdom, or any other jurisdiction that provides mandatory consumer protection laws, nothing in these Terms shall affect your rights under those mandatory laws. You may bring legal proceedings in the courts of your country of residence.

European Economic Area & United Kingdom

If you are located in the EEA or UK:

• You have a 14-day right of withdrawal from the date of purchase. By using the App and initiating a purchase through the App Store, you acknowledge that the digital content delivery begins immediately and you consent to waive the right of withdrawal once the service has been fully provided.
• Disputes may be submitted to the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
• Our legal basis for processing subscription data is the performance of a contract.

Australia

If you are located in Australia, nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.

Brazil

If you are located in Brazil, these Terms are subject to the Brazilian Consumer Defense Code (Codigo de Defesa do Consumidor). Any disputes shall be resolved in the courts of your domicile.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
